Guidelines For registering As TCM Herbalists

1. 宗旨:

a. 卫生部药物管理局於26-05-2003″再次检讨注册传统药物会议”上提及, 全国所有西药店,传统药店及保健品销售店,都必须向有关当局申请零售执照(Lesen Runcit), 而且必须由受到相关领域承认的医药专人来管理 (Premis dikendalikan oleh pengamal perubatan yang diiktiraf dalam bidang yang berkaitan). 也就是说, 马来药店必须由马来人医药总会所承认的专人管理;中药店必须由中医药总会承认的专人管理等等. 为此, 马来西亚华人医药总会必须未雨稠谬, 在政府2006年立法传统医药之前, 保护属下公会会员的执业权力, 带领全国同业应对“传统医药立法”所带来的冲击, 为做好必要的准备工作, 先给中药店业者一个明确的专业地位, “中药师 TCM HERBALIST”.

b. 发给“中药师证书”不但肯定了业者的专业地位, 也会提高消费者对中药店的信心.

c. 将来通过再教育训练, 进一步提高中药店业者的专业水平和服务素质.

2. 背景:

a. 自建国以来, 传统中医药协助国家在医药服务邻域, 为人民的医疗保健, 作出巨大的贡献.

b. 过去, 我国没有专门的学校培训中药业者, 多数以“师带徒或祖传“的方式载培新一代, 许多业者勤奋苦学, 累积了数十年的丰富经验, 对中医药有很深的认识, 是不可多得的中药专业人才.

c. 随着时代的变迁及社会观念的改变, 各行各业都被要求必需专业化, 总会理事会认为必需发出“中药师证书”给合格的中药从业人员, 以肯定他们的专业地位(范围包括: 药零售行业, 中药制药厂, 中药进口商, 中药批发商, 中医师, 中医诊所或医院中医诊疗所等配药工作者(如有)).

d. 卫生部计划在2006年立法管制传统医药, 总会必须及时做好准备工作.

3. 现状与展望:

a. 现有中药店店主都具备一定的行业知识, 许多中药从业员也具备丰富的行业知识, 但却缺乏“证书”, 足以有效证明他们的专业学识.

b. 马来西亚华人医药总会是全国中医师与中药商的伞状组织, 最适合担任审核与发出证书的工作. 总会将用“老人老办法”来发出证书给现有的业者.

c. 中药必需专业化”, 总会希望现有业者不断提升自己, 使自己更专业.

d. 理事会认为, 将来新入行的药店经营者必需经过至少三年以上的正规训练, 拥有受承认的学院发出的证书者, 才有足够的专业资历, 来经营这个”专门”的行业.

4. 申清指南:

a. 名称与定义:

i. 总会以“老人老办法”发出的证书定名为“中药师证书” (TCM HERBALIST).

ii. 此证书的发出在于证明持有人对中药具有一定的认识及总会已通过调查, 肯定了持有人的专业资格.

b. 条件:

i. 申请者必需是属会会员的业主(或其继承人), 拥有固定的营业地址, 商业注册 (Pendaftaran Perniagaan)及执照 (Lesen Tempatan).

ii. 申请者也可以是属会会员的员工, 但是从事中药工作必需超过五年.

iii. 年龄超过21岁.

iv. 没有犯罪记录.

5. 手续:

a. 现有业者:

i. 填写表格(可向全国43间属会索取), 通过各自公会申请

ii. 申请的业主必需附上商业注册证 (Pendaftaran Perniagaan), 营业执照(Lesen Tempatan) , 身份证 (Kad Pengenalan) 影印本及2张护照式半身照片.

iii. 员工申请, 其资历栏必需由雇主签盖推荐.

iv. 将申请表格及相关文件呈交各自公会,由公会负责人查核, 签盖后, 转呈总会处理存档.

v. 以“老人老办法”为现有业者发出证书的处理法, 进行至2006年12月31日结束.

b. 新一代中药业者:

i. 申请者必须接受三年以上正规培训, 拥有相关的证书.

ii. 申请的日期没有限制.

6. 费用:

a. 专业证书费

属下公会调查/鉴定/推荐工作费用…..RM50.00

总会处理/发出证书费………………..RM50.00

b. 每年更新费

属下公会手续费….. RM10.00

总会更新证书费….. RM40.00

7. 总结:

a. 为中药从业员发出”专业证书”有着重大的历史意义, 它不但肯定了业者应有的专业地位, 也代表着中药业开始从自由发展, 迈向规范化与专业化, 对提升中药业的服务素质有绝对的好处, 中药业将为国人的医疗保健作出更大的贡献.除此之外, 也加强了国人对中医药的信赖度, 提高中医药的社会地位.

b. “中药师证书”的发出, 并不代表卫生部已承认中药师的法定地位. 总会是根据本身所拟定之中药师申请准则, 资历标准, 行规道德准则等, 通过各地属会的审核报告, 慎重考虑后, 发出证书, 这种老人老办法, 是过渡时期的办法, 目的是证明会员的专业资格, 维护会员们的执业权利.

c. “中药师证书”的申请属自愿性. 身为行业的总会, 必定会以行业的利益为归依, 总会会据理力争, 争取卫生部承认“中药师证书”.

Traditional and Complementary Medicine (TCM) Herbalists Certificate Issuing Guidelines

  1. Purposes:
    1. The Ministry of Health’s medicine managing department has mentioned at the “Reevaluation on registration of Traditional and Complementary Medicine (TCM) meeting” held on 26-05-2003 – that all the pharmacies, TCM stores and healthcare goods retail shops would need to apply for retail license (Lesen runcit) with the related authority, and would need to be managed by Medical Professionals that are recognized by the related sector (Premis dikendalikan oleh pengamal perubatan yang diiktiraf dalam bidang yang berkaitan). This also means that the Malay TCM shops would need to be managed by those professionals recognized by Purbatama (Traditional Malay Medicine Manufacturers Association); and in turn, Chinese TCM shops would need to manage by professionals recognized by the FCPMDAM. As such, the FACPMDAM would need to take precautionary methods to protect the operational rights of members before the government start their legislation on TCM at year 2006, bringing along the national peers to response on the impact that would be brought along with the “legislation on TCM”, to make for the necessary preparation work, and by first – giving the TCM shop operators a clear professional status, “TCM Herbalist”.
    2. Issuing the “TCM Herbalist Certificate” would not only be affirming the professional status of the operators, it would also improve the confidence of consumer towards Chinese TCM stores.
    3. In the future, the professionalism level and service quality of Chinese TCM shops would be further improved in the future via re-education training.
    4. Background
      1. Since the founding of the country, the Traditional and Complementary Medicine has been helping the country in the medical service sector, making huge contribution to the country in medical healthcare of the citizens.
      2. In the past, Malaysia does not have specialized school in training TCM Herbalist, and mostly the knowledge were passed on via the method of “master training apprentice or ancestral knowledge” to cultivate the new generation, with many of the operators studying hard and diligently, accumulating dozens of years of experience, and have very deep understanding and knowledge about Chinese TCM – rare professionals of Chinese TCM that are hard to find.
      3. The Ministry of Health is planning for legislation control of TCM, and the Association must be prepared in time for the legislation.
      4. Current situation and outlook:
        1. The current Chinese TCM shop owners would be having a certain amount of profession knowledge, and many Chinese TCM practitioners would also be having a rich amount of profession knowledge, yet they lack the “certificate” that would effectively prove their professional knowledge.
        2. The FCPMDAM is the umbrella organization for the Chinese TCM Practitioners & Chinese TCM Merchants in the entire country, which would be most suitable for the job of auditing and issuing certificates, and the Association would be using the method of “old people, old ways” to issue certificate to currently available operators.
        3. Chinese TCM must be specialized, and the Association hopes that current operators could continue to improve themselves, allowing themselves to be more professional.
        4. The committee thinks that in the future, new entrants of TCM shop operators would need to receive at least three years of proper training, as only those with certificates issued by accredited college have enough professional qualifications to operate in this “specialized” profession.
        5. Application Guidelines:
          1. Names and definitions:

i. The certificate issued by Association via the “old people, old ways” method will be designated as “TCM Herbalist”.

ii. The issuance of this certificate is to certify that the certificate holder have a certain amount of knowledge on TCM and has confirmed the professional qualifications of the holders through investigation.

  1. Condition:

i. Applicants must be operators that are members of the Association (or the inheritor), having a fixed operation address, Business Registration (Pendaftaran Perniagaan) and Local Operation Permit (Lesen Tempatan).

ii. Applicants could also be the shop employees under the members, but must be engaged in Chinese TCM work for more than 5 years.

iii. Age must be older than 21 year old.

iv. Have no criminal records.

  1. Procedures:
    1. Current operators:

i. Filling in the form (could be requested from 42 affiliated association over the entire country), and apply through their own associations.

ii. The owners who filed for the application would need to include documents such as Business Registration Certificate, Local Operation Permit (Lesen Tempatan), Identity Card (Kad Pengenalan – Mykad) copy and also 2 passport size photos.

iii. For employee applicants, their qualifications section must be stamped, signed and recommended by their employers.

iv. The application forms and related documents should be submitted to related associations, and would be verify by person in charge of related associations, and after stamping and signing, would be forwarded to the Association for archival processing.

v. The managing method of issuing certificates via “old people, old ways” method, would be carry out until it ends at 31st December 2006.

  1. New generation of Chinese TCM operators:
  2. Applicants must have received more than three years of formal training, and have the related certificates.
  3. There is no deadline for the application date.
  4. Fees:
    1. Professional Certificate fees

i. Subordinate association investigation / verification / recommendation work – RM50.00

ii. Association managing / issuing certificate – RM50.00

  1. Annual renewal fees

i. Subordinate association processing fees – RM10

ii. Association certificate renewal fees – RM40

  1. Conclusion
    1. There is a significant historical meaning in issuing “professional certificate” for Chinese TCM operators, as it has not only affirmed the professional status appropriate to the operators, it also signifies that the Chinese TCM industry has changed from freely developing and advance towards standardization and specialization, and would have absolute benefit towards the improvement of Chinese TCM industry’s service quality, where Chinese TCM would be making bigger contribution towards the medical healthcare of Malaysians. Other than that, it has also strengthened the confidence of Malaysians towards Chinese TCM, thus improving the social standing of Chinese TCM.
    2. The issuance of “Chinese TCM Herbalist Certificate” does not mean that the Ministry of Health has recognized the legal status of Chinese TCM Herbalist. The Association has been issuing certificates according to it’s own formulated Chinese TCM Herbalist application criterion, qualification standards, norm and code of ethics, and other related criterions, and through the audit report of subordinate association all over the country, while all the certificate issuance have been done after serious consideration. Such method of “old people, old ways” is merely used for the transition period, with the aim of proving the professional qualifications of members, and protecting their operational rights.
    3. The applications of “Chinese TCM Herbalist” are of voluntary. As the Association that represent the industry, the interest of the industry would be of priority concern, and the Association would be fighting for having the Ministry of Health in acknowledging the “Chinese TCM Herbalist Certificate” through proper reasoning.
